Understanding Tennessee's Driver License Point System

Tennessee uses a point system to track driving violations and monitor driver behavior on the road. When you receive a traffic ticket or are found at fault in an accident, points are added to your driving record. The Tennessee Department of Safety and Homeland Security manages this system, which aims to encourage safe driving habits and identify dangerous drivers who may need to have their licenses suspended or revoked.

The point system works by assigning a specific number of points to different violations. More serious offenses result in more points being added to your record. For example, a speeding violation might add 3 points, while a reckless driving conviction could add 8 points. These points accumulate over time and stay on your record for different periods depending on the violation type.

Understanding how points work is important because they can directly affect your ability to drive legally in Tennessee. If you accumulate too many points within a certain timeframe, the state may suspend your driver license. A suspension means you cannot legally drive during that period. This is different from a revocation, which is more permanent and requires additional steps to restore your driving privileges.

The point system also affects your insurance rates. Insurance companies review your driving record and may increase your premiums if you have points on your record. Some insurance companies offer discounts for drivers who maintain clean records with no points, creating financial incentive to drive safely.

Practical takeaway: Knowing which violations add points to your record helps you understand the consequences of traffic violations and make informed decisions about how you drive. Keep track of any tickets or accidents you receive and understand how many points were assessed.

Point Values for Common Tennessee Traffic Violations

Different traffic violations carry different point values in Tennessee. The state assigns points based on how serious the violation is and how much risk it poses to public safety. Here are some common violations and their point values:

• Speeding (1-10 mph over limit): 3 points
• Speeding (11-20 mph over limit): 4 points
• Speeding (21+ mph over limit): 5 points
• Reckless driving: 8 points
• Following too closely: 3 points
• Improper lane change: 3 points
• Failure to yield right of way: 3 points
• Driving without a valid license: 4 points
• Improper passing: 4 points
• Hit and run (property damage): 6 points
• Hit and run (personal injury): 8 points
• Driving under the influence (DUI): 12 points
• Vehicular assault: 12 points

It's important to note that these point values may change, and some violations might be assessed differently depending on circumstances. For example, if you cause an accident that results in injury or death, you may face more points than if you cause an accident with only property damage. Always verify current point values with the Tennessee Department of Safety and Homeland Security or a traffic attorney.

Conviction of a violation is what adds points to your record—not the ticket itself. If you receive a ticket but the charge is dismissed, reduced to a non-moving violation, or you are found not responsible, points may not be assessed. This is why understanding your options when you receive a ticket can be important.

Practical takeaway: Review the point values for violations you may have received or are concerned about. Understanding the point value helps you assess how a particular violation might affect your driving record and insurance rates.

License Suspension Thresholds and Timeframes

Tennessee's Department of Safety and Homeland Security automatically suspends your driver license when you accumulate a certain number of points within specific timeframes. The point threshold depends on how long a period you're looking at. These timeframes are sometimes called "lookback periods" because the state looks back at your driving history over that specific time span.

For a 12-month period, accumulating 12 or more points will result in a license suspension. For a 24-month period, accumulating 18 or more points will result in suspension. For a 36-month period, accumulating 24 or more points will result in suspension. The state reviews your record and issues a suspension notice when you cross these thresholds.

When you receive notice of suspension, you will have violated Tennessee's point system rules. The suspension typically begins on the date stated in the suspension notice. During the suspension period, you cannot legally operate a motor vehicle in Tennessee or any other state. Driving while suspended is itself a criminal offense that can result in additional points, fines, and possible jail time.

The length of your suspension depends on how many points caused the suspension and whether you have previous suspensions. A first-time suspension for accumulating too many points is typically 6 months. If you accumulate more points while suspended or if you have multiple suspensions, subsequent suspensions may be longer—sometimes up to 1 year or more.

Certain violations result in automatic suspension regardless of your point total. These include DUI convictions, driving with a suspended license, and certain serious offenses. These automatic suspensions are handled separately from the point-accumulation suspension system and often carry longer suspension periods.

Practical takeaway: Monitor your point total over the 12, 24, and 36-month periods. If you're approaching these thresholds, understand that a suspension is automatic once you cross the limit. Keep records of all tickets and convictions to track your point accumulation.

How Points Age and Can Be Removed From Your Record

Points in Tennessee do not stay on your driving record forever. They age and eventually fall off your record, which means they no longer count toward your point total for suspension purposes. However, the violations themselves remain part of your permanent driving history for insurance and background check purposes.

In Tennessee, points typically remain on your driving record for 3 years from the date of conviction. This means that if you received a ticket and were convicted on January 1, 2021, the points would age off your record on January 1, 2024. However, the violation itself would still be visible on your driving record; it just wouldn't count toward your point total for suspension.

Different violations may have different aging periods. Some serious violations, such as DUI, may remain on your record for a longer period or permanently. Traffic violations resulting in accidents may also be treated differently. Always check with the Tennessee Department of Safety and Homeland Security for specific information about the violations you have received.

You cannot remove points through payment, traffic school, or other voluntary actions in Tennessee, unlike some other states. Points age off automatically according to the time period set by state law. However, getting a traffic ticket dismissed or reduced to a non-moving violation prevents points from being assessed in the first place, which is different from removing points that have already been added.

If you believe points have been incorrectly added to your record, you may request a review by the Tennessee Department of Safety and Homeland Security. This typically involves providing documentation that your conviction was overturned, dismissed, or reduced. Keep copies of all court documents related to your traffic cases for this purpose.

Practical takeaway: Track when points will age off your record. If you're near a suspension threshold, knowing that points age off in 3 years may help you plan your driving and understand when your record will improve. Request a copy of your driving record regularly to verify its accuracy.

Obtaining and Understanding Your Driving Record

Your driving record is a complete history of your traffic violations, points, accidents, and licensing status maintained by the Tennessee Department of Safety and Homeland Security. You can obtain a copy of your driving record in several ways. You may visit a driver service center in person, request a record by mail, or order online through the department's website. There is typically a small fee for obtaining your record, usually between $3 and $7 depending on the method you use.

Your driving record will list each violation with its date, the number of points assigned, and whether those points have aged off. It will also show any suspensions or revocations that have been issued, as well as the dates those actions were effective. The record will indicate your current license status—whether
